On 10 September 2021, the Cartel and Competition Law Amendment Act 2021 came into force in Austria. The Act supplements the turnover-related notification thresholds. Accordingly, in addition to the previous requirements, at least two companies involved in the merger must achieve a turnover of at least EUR 1 million in Austria for a transaction to be notifiable. This change had been demanded by many, given that a lot of cases with very small target turnover had to be notified in Austria. It is expected that the number of merger control notifications in Austria will decrease by more than 40%. The transaction value threshold is still EUR 200 million. However, the new rules are only applicable to mergers notified after 31 December 2021.
